INTRODUCTION
- This document sets out the legal terms and conditions (“Terms”) on which Diarossa (“we,” “us,” “our”) sells products to you via our website, [www.www.diarossa.com] (the “Site”).
- Please read these Terms carefully before placing an order. By placing an order, you agree to be bound by these Terms. If you do not accept them, you should not place an order.
- These Terms apply in addition to the general Terms & Conditions / Terms of Use of the Site (if applicable).

ORDER AND ACCEPTANCE
- You place an order via the Site’s checkout process.
- At the time of order, we may carry out a payment pre-authorisation. Full payment is taken when we accept your order and prepare the item for dispatch.
- After you submit an order, we will send you an Order Acknowledgement Email confirming we have received your order. This is not acceptance of the order.
- Order acceptance and formation of contract occurs when we dispatch the goods or when we send you a “ready for pick up” notice (if applicable).
- If we are unable to fulfill your order (for example, due to out-of-stock, pricing error, or inability to verify payment), we will contact you and cancel or adjust your order, offering you alternative options or refund.
- Once accepted, the price paid is fixed, unless we have notified you of a pricing error before dispatch.
OUR CONTRACT WITH YOU
- The contract is between you (the customer) and Diarossa.
- These Terms (plus any policies linked here, like returns, warranty, etc.) constitute the full agreement relating to your purchase and supersede prior communications.
- You confirm that you are legally capable of entering into this contract and that any information you provide (shipping address, payment details) is accurate.
DELIVERY, TITLE & RISK
- We will arrange delivery using our contracted courier (standard, express, or insured shipping options as offered).
- Delivery times shown on the Site are estimates. We will endeavour to meet them, but delays may occur.
- Risk of loss or damage to products passes to you once delivered (when courier marks the package “delivered”).
- Title (ownership) of goods passes to you when full payment is made and delivery is completed.
YOUR RIGHTS TO END THE CONTRACT
- Unless the product is bespoke, engraved, resized, or otherwise exempt, you have the right to cancel within 30 days from the day after delivery.
- To cancel, notify us via email or via the returns portal, and return the product at your cost.
- Products must be returned in original, unused condition, with packaging, security tags, gemstone certificates, and any included accessories.
- Refunds will be made within 14 days of us receiving and inspecting the returned goods, less any costs for damage or missing items.
- You are responsible for the return shipping risk; we strongly recommend using a tracked, insured courier.
- This right does not affect your statutory rights if goods are defective or not as described.
OUR RIGHT TO TERMINATE THE CONTRACT
- We may cancel or terminate your order before dispatch (with full refund) in circumstances including but not limited to:
• suspected fraud or security risk;
• inability to contact you for verification;
• pricing, supply, or stock errors;
• breach of these Terms by you. - After dispatch, termination is limited to your right to return the goods under the contract.
RETURNS AND REFUNDS

- Jewellery that is bespoke, engraved, resized, or custom-made may not be eligible for return (unless faulty).
- If a gemstone has fallen out or is missing, it is not covered under the standard returns; you should report it immediately; we may offer repair (at cost or under warranty, depending on circumstances).
- Returned items must be adequately packaged and insured; we are not responsible for loss or damage during return transit.
- Refunds will be processed to original payment method (unless otherwise agreed) within the time frame stated above.
INTELLECTUAL PROPERTY
- All content on the Site (images, text, graphics, designs, trademarks, logos) is the property of Diarossa or licensed to it.
- You may view, download, or print pages for personal, non-commercial use, but you must not modify or reuse content, or remove copyright, trademark or proprietary notices.
- You do not acquire any rights by using these materials.
YOUR INFORMATION
- We collect and process personal data in accordance with our Privacy Policy.
- By placing an order, you consent to us contacting you regarding your order and using your data for order fulfilment.
- You may also receive marketing communications only if you opt in, and can unsubscribe at any time.
OUR LIABILITY
- Our liability for any product is limited to the purchase price you paid (to the maximum extent allowed by law).
- We exclude liability for loss of profit, loss of business, loss of opportunity, or indirect or consequential losses.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability which cannot legally be excluded in your jurisdiction.
- We endeavour to keep the Site free from errors and interruptions but do not guarantee that it will always be so.
CANCELLATION / FRAUD POLICY
- We screen all orders for fraud or risk indicators.
- We may cancel orders if: invalid payment, mismatched billing info, unacceptable shipping address, or inability to verify your identity.
- If we cannot contact you within a specified time (e.g. 72 hours) via email or phone, we reserve the right to cancel. Full refund will be made.
- Charges will appear as “DIAROSSA.COM” (or your brand) on your statement.
THIRD-PARTY SERVICES
- We may provide links to third-party websites for convenience (e.g. courier, payment gateways). We are not responsible for their content, policies or operations.
- Your use of third-party services is at your own risk.
INVITING FRIENDS, AFFILIATE & REFERRAL PROGRAMS
- If you participate in referral or affiliate programs, you agree to promotional rules (no spamming, only sending to consenting recipients).
- We reserve the right to revoke referral rewards for misuse or policy violations.
VIRUS, HACKING & OTHER OFFENCES
- You must not misuse the Site (e.g. upload viruses, attempt unauthorized access, launch denial-of-service attacks).
- Doing so may be a criminal offense under applicable law.
- Your right to use the Site will be suspended or terminated immediately upon violation.
PRODUCT INFORMATION
- We aim to display product images, descriptions, weights, dimensions, gemstone specs, and metal types accurately, but minor variations may occur (for instance due to nature of diamonds, lighting or screen settings).
- Carat, colour, clarity, and other gemstone metrics are approximate within industry standard tolerances.
- Where products come with certificates (GIA, IGI, etc.), we shall provide those as specified in the product listing.
- All goods are subject to availability.
DISCLAIMER
- The Site, content, and products are provided “as is” and without warranties of any kind (subject to statutory rights).
- We do not warrant error-free operation, continuous availability, or that defects will be corrected.
- We disclaim implied warranties such as merchantability or fitness for a particular purpose, to the extent permitted by law.
- These disclaimers do not apply to consumer rights which cannot be excluded legally.

- Governing Law: These Terms are governed by the laws of England & Wales (or your jurisdiction), and disputes shall be resolved in the courts of that jurisdiction.
